In my column for Business News Magazine – June, 2024, I explore the proposed civil and criminal penalties for aged care providers under the new Aged Care Act.

The proposed changes could see aged care provider directors, executives and a wide range of managers facing up to five years in prison if they breach their statutory duties. This has been met with some concern by the Aged Care industry as there is a risk that overly draconian measures may drive away talented professionals and create an environment of fear rather than improvement.

In response to the proposed changes, my article explores why leveraging the existing banning order regime could be the smarter choice for enhancing accountability while supporting the sector’s stability.
